Be Afraid of Cynthia Dunbar

Can we truly even imagine an America under an Obama Administration? I sincerely believe that an Obama Administration would ultimately mean one thing…the end of America as we know her.

First, I cannot understand how we can potentially elect a man who most likely has violated the Constitution in his very attempt to serve as Commander and Chief. “No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President;” U.S. Constitution, Article II, Section I

Rather, I perceive it [terrorist attack on U.S. soil in first six months of Obama Presidency] will be a planned effort by those with whom Obama truly sympathizes to take down the America that is threat to tyranny. What nobody seems to be discussing is the fact that if such an attack takes place, what about Martial Law? What happens to expand executive power when a state of civil disorder is declared?

I fear for our great nation and her potential demise should we as Americans elect Sen. Obama. I shall take no joy in saying “I told you so” if Obama gets elected. But just for the record, remember, “I told you so.”

Is this the ranting of a fringe blogger? A foaming-at-the-mouth late-night talk radio host? A drunken conspiracy nut arguing politics in a bar? No, it’s the ranting of someone named Cynthia Dunbar, who holds a position on the Texas State Board of Education, serving on the Committee on Instruction and a proponent of teaching creation science/intelligent design in Texas classrooms. Yes, she’s a real winner, and we have two more years before we can work to vote her out … something I wholeheartedly intend to do.

I could rant for hours on this subject, but it’s late, and I really do have to be up early in the morning. So I will keep it brief. Really brief. I’m falling asleep. So all I have to say is this:

Cynthia Dunbar has no business whatsoever serving on the Texas State Board of Education, and I will be doing everything in my power to see to it that she and her cronies are voted off that board as soon as possible.

Additionally, I would like to suggest that everyone do a little research on the members of their own State Board of Education and learn about the people they probably don’t put any thought into except for the two seconds on election day when they vote for them, even though all they may hear about them are a few TV commercials (if that). Do not be an ignorant voter, and whether or not you have kids in the public schools, make an effort to be aware and care about who is making decisions about what they learn. We all want the young person wiping our noses and butts in the nursing home to be somewhat intelligent, don’t we?

I don’t want her little tirade to be lost into the memory hole, because it might be useful at a later date Because it was removed from the internet today, behind the cut is the entirety of her screed.

Freedoms Will Be At Risk Under President Obama

Can we truly even imagine an America under an Obama Administration? I sincerely believe that an Obama Administration would ultimately mean one thing…the end of America as we know her. First, I cannot understand how we can potentially elect a man who most likely has violated the Constitution in his very attempt to serve as Commander and Chief. “No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President;” U.S. Constitution, Article II, Section I

If Obama were a natural born citizen who never lost his citizenship through his adoption while living in Indonesia, then why does he obstinately refuse to present valid documentation? The fact that a Federal Court Judge did nothing should not surprise any of us. After all, we know all too well the attack this great Country undergoes on a daily basis from our own militant leftist Judicial Branch. Can you imagine how much worse this will get with Obama appointees?

There is one glimmer of hope in all of this. There is a difference between a voidable contract and one that is simply void. A voidable contract is able to be ratified whereas a void contract is void at its inception and cannot be cured at any point. If in fact Obama is not constitutionally eligible to be President, this is not something he can ever cure. His election, his swearing in and oath of office, his service of 3 days, 3 months, 3 years does not ever truly convey to him the authority of President of the United States. It is void at its inception and, as such, is open to a valid legal attack at any time.

So we can imagine the blatant disregard for our Constitution, but what other threats does an Obama administration pose? We have been clearly warned by his running mate, Joe Biden, that America will suffer some form of attack within the first 6 months of Obama’s administration. However, unlike Joe, I do not believe this “attack” will be a test of Obama’s mettle. Rather, I perceive it will be a planned effort by those with whom Obama truly sympathizes to take down the America that is threat to tyranny. What nobody seems to be discussing is the fact that if such an attack takes place, what about Martial Law? What happens to expand executive power when a state of civil disorder is declared?

Supreme Court Justice Holmes in the unanimous decision of Moyer v. Peabody, stated the following:

“…[I]t is familiar that what is due process of law depends on circumstances. It varies with the subject matter and the necessities of the situation…. In such a situation we must assume that he had a right under the … constitution and laws to call out troops…. That means that he shall make the ordinary use of the soldiers to that end; that he may kill persons who resist and, of course, that he may use the milder measure of seizing the bodies of those whom he considers to stand in the way of restoring peace. Such arrests are not necessarily for punishment, but are by way of precaution to prevent the exercise of hostile power. So long as such arrests are made in good faith and in the honest belief that they are needed in order to head the insurrection off, the [Executive] is the final judge and cannot be subjected to an action after he is out of office on the ground for his belief. . . When it comes to a decision by the head of the State upon a matter involving its life, the ordinary rights of individuals must yield to what he deems the necessities of the moment. Public danger warrants the substitution of executive process for judicial process.”

Granted, this is not the same position that was taken by the Court in ex parte Milligan (71 US 2 [1866]). That Court resoundingly said, “Martial law … destroys every guarantee of the Constitution.” Reminding Americans of similar actions that had been taken by the King of Great Britain, which in turn were part of the basis for the Revolution, the courts stated, “Civil liberty and this kind of martial law cannot endure together; the antagonism is irreconcilable; and, in the conflict, one or the other must perish.”

Factually, such militaristic rule is to be established by the Legislative Branch. “The Congress shall have Power To … provide for calling forth the Militia to execute the Laws of the Union, suppress Insurrections and repel Invasions;” U.S. Constitution Article 1, Section 8 However, the Constitution further states that the President, “…shall from time to time give to the Congress Information on the State of the Union, and recommend to their Consideration such Measures as he shall judge necessary and expedient;” Article II, Section 3 Should the Senate and the House be under Democratic control and Obama comes to them advising of a threat to our Nation, is there any doubt that Obama will have his way? Additionally, since we’ve clearly seen that Obama appears to have no respect for the Constitution itself, why should we expect that if elected, all of a sudden he will try to comply with its restraints?

I fear for our great nation and her potential demise should we as Americans elect Sen. Obama. I shall take no joy in saying “I told you so” if Obama gets elected. But just for the record, remember, “I told you so.”

  1. The woman is a self-promoting, egotistical lunatic. She could “pal around” with Michelle Bachman of St. Cloud, Minnesota. Michelle thinks there has been a creeping infiltration of unamerican activity into the halls of congress.

  2. “Creeping infiltration of unamerican activity”….Yeah, all those neo-cons who are trying to put the church into the state!

  3. I’ve know for a while she wasn’t anyone I wanted on the SBOE, but this latest insanity is really just too much. She has got to go in 2010, before the new science textbooks are chosen in 2011.

  4. She reminds of Anne Coulter and that’s not a compliment.
I don’t understand how such an educated (hah!) woman could be so ignorant. She’s an attorney and so I’d figure she’d be better at researching to get to the facts.
Such a shame that she’s behind the public education system of Texas and even sadder that she’s in for two more years. Well one more year since it’s almost 2009

  5. Thank you! I just googled for the full text of this article after finding it removed from the original website, and came across your blog that way.

    Sheesh. This woman is insane.

  6. I find myself most annoyed by her insistence that he isn’t an American citizen. I’m just a normal person, living a normal American life, and I find the need to prove my status as a person born in the USA comes up every few years. It’s not possible to get a drivers license or SS card without doing so. It’s not possible to get a passport without doing so. It’s not possible to get new copies of these things without doing so. That’s just the normal stuff we all have to do.

This guy has been running for offices for a while now, is a sitting Senator with a security clearance. Having once been through a security clearance vetting, I can assure people someone would have noticed if a Senator wasn’t actually a citizen, let alone someone running for and winning a presidential election. Unless the authorities in Hawaii are lying and the government offices involved in doing security checks are either lying or totally incapable, there’s no way he isn’t a citizen. It’s stupid to think he isn’t.

And the rest of it is just insane babble.

I went back after making this post to grab the full text, because I knew it would vanish. When elected officials spout this kind of nonsense, it needs to not disappear.

  7. The insinuation she makes regarding Obama’s “natural born” citizenship would be crass ignorance for a lay person, but this individual, Cynthia Dunbar, is an attorney, so this is simple deceit. Her insinuation that because his mother married an Indonesian and her son spent a few years in Indonesia, this casts a question upon his citizenship. Even if he were born outside of the U.S., if his mother is a U.S. citizen, he is a citizen. However, he was born in Hawaii, which, even Ms.Dunbar should realize, is a part of the U.S.A. So is it ignorance or deceit? If it were the former, she should turn in her license to practice law.

  8. I mark it up to ignorance of the willful sort. I think she just really, really wants it to be true, so it’s true to her. And as far as her law degree goes, it’s from Regent University (1990), founded by Pat Robertson. She didn’t pass the Texas Bar until 2005, as far as I can tell, so if she has 17 years of legal experience, it must not be in Texas. I don’t know, still digging up stuff on her. Know thy enemy, right?

And the whole citizenship flap is simply ridiculous. He was born in Hawaii. End of argument. Anyone believing otherwise is an ignorant fool.

  9. I don’t know if you’ve seen it, yet but you just got linked to on scienceblogs by a great writer named Greg Laden. Jump over to his blog

    and say Hi!!!

He writes a great blog that I read everyday. You won’t be sad to go there.

    Keep up the good work!!!!

You know, we are going to have to come up and take you out for a celebratory dinner soon. This is too cool!!!!

  10. Christ on a stick; if this woman thinks that the current US judicial system is “militant leftist”, I’d hate to see what she thinks a proper “centrist” or right-wing judicial system would look like.

  11. Cynthia Dunbar is one of 15 members of the State Board of Education. These are big districts. Texas has 32 members of the United States House of Representatives, 31 state senators, and 150 state representatives, so her district is the size of that for 10 state representatives, and for more than two Members of Congress.

Her district includes all of Austin and Travis county north of Town Lake(dammed up Colorado River,
aka Lady Bird Lake). It includes all of Williamson county. It includes 87% of Fort Bend County, just west of Houston, and it includes a whole bunch of connecting rural counties between Austin and Houston. It includes the 40 acres of the main campus of the University of Texas at Austin.

In 2006, when she was elected to her first, and so far only, 4-year term, she defeated another Republican in her primary, then swept over the Libertarian in the general election. Where were the Democrats? They weren’t there. No Democrat even paid the $300 filing fee, or got the few hundred signatures necessary to get on the ballot.

Filing for this office is in December 2009. I’m not a good candidate myself, but I’m sure trying to get Democrats talking, and with talking leading to action, so that we have one or more good candidates who actually file in December 2009. One does not have to be an educator. Two of the very good members of the current board are attorneys, one is in real estate, one a community volunteer. One does not have to be an educator, or even a college graduate.

The office pays no money, but it does pay expenses.
Members are put up at the Renaissance on 15th St. At least one member I know flies here for the meetings. Almost all meetings are here in Austin, at the Travis office building, 3 blocks north of our State Capitol. Meetings are on Thurs-Fri., or on Weds.-Fri. about seven times a year.

I instigated a discussion, with six of us attending the first session last Saturday at a bakery here in Austin. We included Democrats, such as I, but also people who might put efforts into defeating Dunbar in the Republican primary, or in working with the Libertarians.

Austin, Texas, in the section of Austin north of Town Lake, in SBOE 10, currently misrepresented by the Hon. Cynthia Dunbar.

  12. This woman is a lunatic and really idiotic beyond belief. She
has every right to believe all the fairy tales in the Bible
but in my view she has no right to attempt to force her medieval views on the public schools in Texas.

But then what can any rational person expect from someone who
graduated from Holy Roller U…after all, it was founded by
the late American Ayatollah Jerry Falwell.

  13. I’m going to be making more posts with info about Dunbar soon. My ranting was disrupted by jury duty.

But yeah, this woman and several other members of the SBOE need to go.

  14. OK, you all are welcome to join us in face to face discussion. We’re talking about both districts 5 (Ken Mercer) and 10 (Cynthia Dunbar), about getting good candidates to run against them, and about getting Democrats actually to file for this office, which Democrats did not do when these two were elected to four-year terms in 2006.

Want to join us tomorrow, 2pm Saturday, November 22?

Where: The Upper Crust bakery, 45th and Burnet Rd.
in Austin, Texas (in an area misrepresented by the Hon. Cynthia Dunbar).

How you’ll recognize me: Wearing a maroon, University of Chicago shirt.
